Product Liability

The properties set forth in technical data sheets, catalogues, brochures, etc. (hereinafter referred to as “documents”) are based on the results of testing of typical material produced by the Fibon group. (hereinafter referred to as “Fibon”) Some variation in product properties is typical. Fibon does not represent or warrant that the use of its product will have the results described in the documents or that the information provided is complete, accurate or useful. The user should test the product to determine its properties and its suitability for the intended use. Fibon expressly disclaims any liability for any damage, harm, injury, cost or expense to any person resulting directly or indirectly from that person’s reliance on any information contained in the documents. Nothing contained in the documents constitutes a representation or warranty as to any matter whatsoever. Fibon makes no warranties whatsoever in the documents, expressed or implied, including any implied warranty or fitness for a particular use or purpose. Claims for errors, shortage, defects or nonconformities ascertainable upon inspection must be made in writing after Buyer’s receipt of products. Products claimed to be nonconforming or defective must promptly be returned to Fibon for inspection. Claims not made as provided above and within the applicable time period will be barred. Fibon will, at its option, either repair or replace nonconforming or defective products for which it is responsible or return the purchase price to the Buyer. Fibon shall in no event be liable for incidental, exemplary, punitive or consequential damages.
